These Terms and Conditions ("Terms") govern your use of the services provided by the website and design agency POLYGIG ("we", "us", or "our"), a trading name of Jon Edgell. By engaging our services, you agree to these Terms.
1. Services
We provide web design, development, hosting setup, maintenance, SEO, and related digital services. Where projects are subject to separate written Proposals or Service Agreements detailing scope, timeline, deliverables, and pricing, in case of conflict, the Proposal/Service Agreement takes precedence over these Terms.
2. Client Responsibilities
You must provide timely access to necessary materials (content, images, logos, login credentials, etc.).
You are responsible for the accuracy, legality, and copyright of all content you supply.
3. Project Timeline and Revisions
Timelines are estimates and may shift due to client feedback delays or unforeseen complexities.
Unless specified otherwise in the Proposal, we include up to 2 rounds of revisions per major phase. Additional revisions are billed at our hourly rate of £40/hour.
4. Payment Terms
Payment terms are within 14 days of invoice date.
A deposit may be required to commence work.
Remaining balances are due upon project completion and before launch/handover, unless otherwise agreed.
Payments are non-refundable except as outlined in the Refund Policy below.
Late payments may result in suspension of work or services.
5. Refunds and Cancellation Policy
Deposits: The initial deposit is non-refundable once work has begun, as it covers initial planning, research, and design time.
Mid-project cancellation: If you cancel after work has started, you will be billed for all work completed up to the cancellation date at our hourly rate or a pro-rated portion of the project fee. You will receive source files for the work completed and paid for.
Completed projects: No refunds are issued for completed work that has been delivered and approved.
Hosting / Maintenance plans: Direct (ours) monthly or annual subscriptions can be cancelled with 30 days’ notice. No refunds for partial months. Prepaid annual plans are not refundable but may be transferable to a new project upon request. We can not control terms for Indirect (paid to other agencies on your behalf) subscriptions.
Exceptions: Refunds may be considered on a case-by-case basis in situations involving our significant failure to deliver as agreed (e.g., major breach of contract).
6. Intellectual Property and Ownership
Upon full payment, you receive ownership of the final website design and developed code (excluding any third-party tools, plugins, or licensed assets).
We retain the right to display the project in our portfolio and marketing materials unless you request otherwise in writing.
You grant us a non-exclusive license to use your content for the purpose of providing the services.
7. Warranties and Liability
We warrant that the work will be performed in a professional manner consistent with industry standards.
We do not guarantee that the website will be error-free, rank #1 on search engines, or generate specific business results.
Our total liability shall not exceed the total amount paid by you for the specific project.
We are not liable for any indirect, consequential, or punitive damages.
8. Third-Party Services and Plugins
We may recommend or integrate third-party services (hosting, domains, plugins, stock images, etc.). You are responsible for any associated costs where not included within our fees, and the terms of those providers. We are not liable for changes or downtime caused by third parties.
9. Termination
Either party may terminate the agreement with written notice. You remain responsible for payment of all work completed up to the termination date.
10. Governing Law
These Terms shall be governed by the laws of England and Wales without regard to conflict of law principles.
11. Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the new Terms.

POLYGIG respects your privacy. This Privacy Policy explains how we collect, use, and protect your personal information when you visit our website, inquire about services, or become a client.

Payment Information: We do not store credit card details. Payments are processed securely via Stripe or PayPal.
